Welcome to AskPrice. These Terms of Service ("Terms") govern your use of the AskPrice website (the "Site"), operated by LINDA - SHOPPING LLP, a limited liability partnership registered under the laws of the Republic of Kazakhstan, doing business as AskPrice ("we," "us," or "our"). Please read them — they're short by legal standards, and they matter. Our Privacy Policy describes how we handle information; please review it as well.

1. Acceptance of These Terms

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. What AskPrice Is (and Isn't)

AskPrice is a free, informational price-tracking service. We display pricing, availability, and product information based on publicly available information for six US department stores: Macy's, Bloomingdale's, JCPenney, Nordstrom, Nordstrom Rack, and Kohl's. For each product, we show recent price data — up to 14 days of price history that we have recorded — along with product details and links to the retailer's own page.

To be clear about what the Site is:

• It is informational only. We provide pricing and product information for informational and comparison purposes. Nothing on the Site is an offer to sell, or a solicitation of an offer to buy, any product.
• We sell nothing. You cannot purchase anything on AskPrice. Every "shop" or "view at retailer" link takes you to the retailer's own website, where any purchase is made directly with that retailer, on that retailer's terms, at that retailer's current price.
• Price history means what we recorded. When we show price history, we are showing the prices we observed and recorded during that period — not a guarantee of the retailer's actual or complete pricing over time.
• No accounts. The Site has no visitor accounts. Items you save with the heart button are stored in your own browser.

3. Accuracy of Information — Verify With the Retailer

Prices, availability, discounts, and product details shown on the Site are updated periodically and reflect the information available as of the time indicated (or as of our most recent refresh). Retailers change prices and availability constantly, and information on the Site may be outdated, incomplete, or inaccurate at the moment you view it.

We make no warranty that any price, discount, or availability shown on the Site is accurate or current, or that it will be honored by any retailer. Always verify the current price and availability on the retailer's own product page before making a purchase. We also do not claim that any price shown is the best or lowest price available anywhere.

4. Our Independence; Affiliate Links

AskPrice is an independent service. We are not affiliated with, sponsored by, endorsed by, or partnered with Macy's, Bloomingdale's, JCPenney, Nordstrom, Nordstrom Rack, Kohl's, or any brand whose products appear on the Site.

Some outbound links on the Site may be affiliate links, which means we may earn a commission if you click through and make a purchase on a retailer's site. This costs you nothing extra and does not change the price the retailer charges you. Commissions play no role in how prices are compared or which store is shown as cheapest — those come from the price data itself.

5. Trademarks and Product Images

Retailer names, brand names, and logos shown on the Site are trademarks of their respective owners, used only to identify the source of the prices and products shown. Product images are displayed to identify the products being compared. Their appearance on the Site does not imply any affiliation with, or endorsement by, their owners. If you own rights in content shown on the Site and have a concern, our DMCA & Content Complaints page describes how to send a notice, or contact us at the address in Section 16.

6. Our Content and Intellectual Property

The Site's design, code, original text, and our compilation and presentation of pricing data are owned by us or our licensors. We grant you a limited, non-exclusive, revocable license to access and use the Site for personal, non-commercial purposes. You may not reproduce, republish, redistribute, or commercially exploit the Site's content or data, or extract it in bulk, without our prior written permission.

Some product descriptions and articles on the Site are generated with the assistance of AI from underlying product and pricing data. They are provided for convenience, may contain errors or inaccuracies, and should not be relied on as a substitute for the retailer's own product information.

7. Third-Party Websites

The Site links to retailer websites and other third-party sites for your convenience. We do not control those sites and are not responsible for their content, prices, policies (including privacy policies), or practices. If you visit a third-party site, you do so at your own risk and subject to that site's terms. Any purchase, shipping, return, warranty, or customer-service matter is solely between you and the retailer — we are not a party to your transaction with any retailer.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE INFORMATION DISPLAYED WILL BE ACCURATE, COMPLETE, OR CURRENT.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR SAVINGS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY INFORMATION ON IT — INCLUDING ANY PURCHASE DECISION MADE IN RELIANCE ON PRICES OR INFORMATION SHOWN ON THE SITE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED FIVE US DOLLARS ($5.00).

Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above limitations may not apply to you. AskPrice is free to use, which is why the liability cap is nominal.

10. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and reasonable expenses (including attorneys' fees) arising out of your use of the Site in violation of these Terms or applicable law, or your violation of any third party's rights. In plain terms: if you break these Terms or the law using the Site and someone sues us over it, you cover the resulting costs.

11. Acceptable Use

You agree not to use the Site in a way that disrupts or degrades it for others. In particular, you may not:

• overload or disrupt the Site or its infrastructure, including through abusive automated access;
• access the Site through automated means to harvest, extract, or index its content or data in bulk, except by search engines operating under our published robots directives;
• frame, mirror, or republish the Site or its data;
• circumvent security or access-control measures;
• use the Site for any unlawful purpose.

We may limit or block access at our discretion, including for violations of this section.

12. Availability of the Site

We may modify, suspend, or discontinue the Site or any feature at any time, with or without notice, and may restrict or terminate access to the Site at our discretion. We have no obligation to maintain, update, or continue offering the Site.

13. Changes to These Terms

We may revise these Terms from time to time. Changes take effect when posted on this page, with the effective date above updated accordingly. Your continued use of the Site after a change takes effect constitutes acceptance of the revised Terms. We encourage you to check this page occasionally.

14. Disputes and Governing Law

Before bringing any formal claim, we ask that you first contact us so we can try to resolve the issue informally — most issues are resolved this way.

These Terms, and any dispute arising out of or relating to them or your use of the Site, are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Any claim that is not resolved informally must be brought exclusively in the state or federal courts located in Delaware, and you and we each consent to personal jurisdiction and venue there. If the law of the place where you live gives you mandatory consumer rights that cannot be limited by contract, nothing in these Terms takes those rights away.

15. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms are the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
